Swift Sunol Heavy Duty Towing provides towing, recovery, and roadside assistance services in Sunol, CA and surrounding areas. Services include but are not limited to heavy duty towing, accident recovery, flatbed towing, winch-out service, roadside assistance, and commercial vehicle towing.
We reserve the right to refuse service in situations where safety conditions, equipment limitations, legal restrictions, or other factors make it impractical or unsafe to perform the requested work. We also reserve the right to modify or discontinue any service at any time without prior notice.
Any estimate provided over the phone or through our website is an approximation based on the information available at the time. Final pricing may vary depending on the actual conditions encountered at the scene, including vehicle weight, terrain, distance, time required, equipment used, and time of day.
California law regulates the rates towing companies may charge for non-consensual tows - those requested by law enforcement. For all other service requests, rates are as quoted by our dispatch team. We will communicate any material changes to the estimate before proceeding with work that significantly increases the cost.
All quoted prices are in U.S. dollars. Taxes and applicable fees may be added to the final invoice.
Service requests are scheduled based on crew and equipment availability. We make every reasonable effort to meet estimated arrival times, but actual response times may vary due to traffic, weather, demand, and other factors outside our control. We are not liable for delays caused by circumstances beyond our reasonable control.
If you need to cancel a scheduled service, please contact us as early as possible at (925) 233-3791. Cancellations made after a crew has been dispatched may be subject to a trip or dispatch fee to cover the cost of mobilizing the equipment and crew.
Payment is due at the time of service unless a prior billing arrangement has been established in writing. We accept cash and major credit cards. Checks are accepted at our discretion. For fleet or commercial account customers, payment terms are as agreed in writing at the time the account is established.
Unpaid invoices are subject to late fees as permitted by applicable law. We reserve the right to place a lien on vehicles or property as authorized under California law for unpaid towing and storage charges.
If a vehicle is stored at our facility following a tow, daily storage fees apply from the date of arrival. Fees are calculated per calendar day. You are responsible for retrieving your vehicle promptly and for all accrued storage charges. We will provide notice as required by California law before initiating any lien sale process for unclaimed vehicles.
You agree to provide accurate information about your vehicle, its location, and the nature of the service needed. Providing false or misleading information that results in the dispatch of improper equipment or increases costs may make you responsible for any resulting expenses.
You are responsible for removing personal items from your vehicle before it is towed. We are not responsible for personal property left in vehicles during towing or storage.
Swift Sunol Heavy Duty Towing will exercise reasonable care when handling your vehicle. However, our liability for any damage that occurs during towing or recovery is limited to the actual cash value of the vehicle at the time of service, not to exceed the amount paid for the towing service, except in cases of gross negligence or willful misconduct on our part.
We are not liable for pre-existing damage to your vehicle, damage caused by structural failures in the vehicle itself, or damage resulting from conditions at the scene that were disclosed to you before work began.
Under no circumstances will Swift Sunol Heavy Duty Towing be liable for indirect, incidental, consequential, or punitive damages arising from the use of our website or services, including but not limited to lost profits, loss of data, or loss of use of a vehicle.
Our services are provided on an "as is" basis. We do not warrant that our services will meet every expectation or that errors will be entirely avoided. Our website content is provided for informational purposes only and does not constitute a guarantee of service availability, response time, or outcome. No warranty, express or implied, is made regarding fitness for a particular purpose beyond what is stated in these terms.

If a dispute cannot be resolved informally, the parties agree to submit the matter to binding arbitration in Sunol County, CA, under the rules of the American Arbitration Association, except where prohibited by applicable law. This does not prevent either party from seeking emergency injunctive relief in a court of competent jurisdiction.
These Terms and Conditions are governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal action arising from these terms or from our services that is not subject to arbitration will be brought in the state or federal courts located in California.
